I don't know about the down load site mentioned but it is Okay as long as such down loads are legal (means paid).

Jheena Lodwick must get paid for the music she produced and also for the efforts she had put down in learning, practicing and perfecting her skills.

FYI
Please also refer to a band called "Marillion" and album called "Marbles".
Very few bands/Individuals can demand the respect of fans to do that.
I am not aware of this Lady's repute.

My only concern is the Pricing of CD's.
Bands like Tool and Marillion make it a pleasure to own one of their Products.
Selling Products with an intent to extort is different and Selling music to reach out is different.

It's very doubtful if such a download will sound as good as a XRCD on a good CDP. And therefore I don't think it's worth spending the money.

I am not clear whether you are talking about my sale prices or CD prices in general (that tempted you for illegal downloads). Anyway , XRCD recording is far better than standard Redbook CDs and that's why XRCDs are priced higher than standard CDs.

The XRCD's I sold were priced Rs 1700 each to buy a new. I sold them at 1/2 the price at Rs 800. All sold XRCDs were excellent as good as a fresh from the rack , the music lover who purchased those XRCDs had posted a feedback on www.hifivision.com , please have a look at it.

Somebody (on purpose?) posted a link of a (illegal) download of the same album (under the impression that my XRCDs are still unsold!), that's why I asked the question whether that is a legal download or what? Just to check what is the price for any such high quality legal downloads.

I buy legal only, 400+ legally purchased CDs are more than enough for my enjoyment, I don't steal music. Those who go criminal , let them go but my request is at least do not promote / support such illegal activities on public places like this forum. It is a shame that well educated (?), well placed people with resources that can set up a HiFI system costing more than Rs 500K are doing this.

Nothing against you Alywn , excluding this illegal download we are still friends , I believe.

But I have to confess that I have pre- Ordered CD's from Tool and Marillion at about the same price $ 35.
But it comes with an insane Artwork.
Marillion came with a whole metal box with more than 1200 photographs and your name mentioned as one of the contributors to the making of the album.

You confirmed the sale of the Jheena Lodwick XRCD to me on (Jun 26. 2008, 16:11)and asked me to send you an "at par" cheque for Rs.850/-which I did promptly. (Jun 27. 2008, 05:29)You confirmed receipt of the cheque on June 30 morning(I am from Madras)

However after receiving the cheque, you expressed your inability to sell me the XRCD,and returned my cheque.

I assumed that you had changed your mind and had decided not to sell the XRCD.From the above posts I see that you have sold the XRCD to someone else,after confirming the sale to me and asking me to send you an "at par" cheque for the XRCD.

Suhas, I too have always purchased CD's until I came across TOOL, MARILLION and RADIOHEAD who offered so much more than a digital disc...it was always a very personal experience to own any of their ART...

Each one here is (presumably) an adult, and needs to take their own call.

Some time ago, a memeber was curious to hear an XRCD. He wrote that on the forum. This site could give him a taste.

However, not everyone on this forum has a 'Good" CD player, and its arguable if the XRCD download would atleast sound better than a regular CD... atleast its unlikely to sound worse ... IMHO ofcourse !

I had a VERY SIMILAR Experience dealing with G_S_Madhav and I thought it was an aberration, so I just shut my self out.

Let me elaborate.

1. Members of the Forum will recall that when GS Madhav put up his first list, I replied I would take them all, as a lot.

2. Confirmed by his personal message (PM) dated 28th June :


So I confirm that all CDs from first list considered as SOLD to you.

, but then he came back to me saying that ( the cream of the lot, as far as I was concerned ) were sold out. I could ofcourse have the crumbs...

3. Freight : I found shipment charges un-necessary, since he lived in Pune, less than 2 Kms from where my Mother-in-law lived. Hence I requested if he would drop off ( the remaining Crumbs ) at her place, and collect the money.

In his PM to me on 28th June, he said :


I am Okay with your second option and will drop your CD at your Mother-in-law's place.


Vide his message to me dated 30th June he wrote :


Your Shipping Cost totals to: Rs 125


I felt I was aiming at a continiously moving target, and simply cancelled the deal.

I would personally speculate that Suhas prefers to sell the CDs locally... who would not.

But those options should be explored BEFORE putting stuff up on the forum for sale, and not pulling out / seliing locally after someone confirms their commitment to buy.

I hold no grudges... just that it did not work out. Only in this case, it seems to have happened to more than just me...

Rajiv, you are mixing two different issues. What you said about your XRCD order is very correct , it indeed happened. But you forgot to mention that while returning the check I offered you some compenasation too. Yes, I offered you to refund the amount you paid on courier charges (Speed Post)as well as some more to cover any incidental charges you might had incurred. I think that was fair enough and far better than many business houses.

Now , allow me to tell you and many others following this thread, the reason as well as what happened behind the screen:

Those XRCDs and many other I sold then after were not mine but from my cousin's personal collection. I think this was made clear in the postings. Naturally my cousin was the decision maker and I was just providing the support , like checking each and every CD for any problems , then posting it on the forum/s , collecting payments, packing CDs, dispatching CDs etc.

XRCDs being first to go, my cousin was rather worried about whether those will get sold or not. The list was posted on two forums. One guy from the other forum responded and confirmed all three XRCDS in one go. Both me and my cousin were happy. But the guy didn't contact then after . My cousin got worried or rather became impatient,though I was telling him to hold on for a while.

In the mean time I recieved your mesage about one XRCD from the three posted. My cousin , thought not three but at least one XRCD will go , so he asked me to go ahead and confirm the sale of only one XRCD to you though I was insisting for waiting the first guy to either pay or decline.

While your check was in the mail , the first guy paid the money! Now what to do? Committments were given to two parties for the same XRCD!!! I adviced my cousine to buy the same title and fill both orders, indeed I tried but no luck , no where the same title was availbale for sale.

At this point , my cousin who was the owner (and final decision maker) of those XRCDs decided to go with the guy who paid for all three XRCDS, in fear that if he sells that one XRCD to you then the first guy might cancel the order (because he then won't be getting all three titles he asked for) and two XRCDS will remain unsold!

So he ordered me to cancel the deal with you and go with the other guy (buyer of all three XRCDs) . Which I did but the compensation thing was offered of my own from my own pocket.

Rajiv, I could have explained this to you that time also but you sounded quite upset then. I hope things are clear to you and all those following this thread.

And believe me , I sold my cousin's 187 CDs till date , I haven't made a singel paisa out of it. All money collected is deposited in my cousins's (in fact his father-in-laws' ) bank account.

You are talking about one stray incident buit there are at least half a dozen perosns who purchased CDs from me are quite happy and posted glowing feedback comments on the other forum. CD selling is not my business, I work in an IT company (India's Number 1) for my bread and butter and hold quite a senior position over there. Cheating / dishonesty in any manner is not in my blood. I will never do it and even my enemies (if any) will agree on it 100%.


The "It is a shame .......500K system..." statement was direted to those who steal music and further promote and support such activity , and certainly not towards you If you are not in that illegal download business then you should not get upset about it or rather be supporting my stand here. But unncessarily bringing and mixing some other unrelated issue you are indirectlly supporting those pirates.

I hope this is clear enough. For me the issue is closed.

Amp_Nut ji you are also hiding something here.

The list was posted on two forum , This one and the hifivision.

I posted the list 30 odd titles, and left for office. In my offcie , for some strange reasons this German forum is blocked on our network (web chat category!) how ever I can access hifivision. So there was no way for me to check your posting on German forum till I reach home. In the mean time one guy on that other forum posted and confirmed most of the tiltes from your list.

I belive about the same time , Abhi_pani called me on my cell, (yes , he is having my cell number) and informed me about your posting. I remember I said to Abhi_Pani that I can't access German forum from office and I need to go home to check what Amp_nut had asked for .

That evening in fact I was very late that date. I reached home saw your post as well as your PM (Jun 27. 2008, 04:50 giving the list.)

Why that '12 The magic hour – Wynton Marsalis quartet 150(445)' dropped? No it was not sold to anybody else (prove that and win $1 million!) , but when I opened the CD jewel box to check the CD (It is always my practice to check each and every CD by playing it on system) to my surprize there was no CD inside!!! Just the cover. I searched here n there a lot but couldn'y locate that CD (it is still missing !) so I decided to drop that CD from List. That's why I said in that PM " Total 7 CDs

You suggested Kalyani Nagar or Boat club locations for delivery , both are 10 and 15 KM from my place of residence (Karve Nagar) and not 2-3 KM as you mentioned. , that is 20/30 KM two way. so what is wrong if I ask for petrol expenses for 20/30 KM of travel ? This sale was not a charity affair for me. If I sppend time and money in delivering CDs to location of your choice then I have full right to be compensated for it.

You asked 12 odd titles those are already sold to someone else. When this was made clear to you, you then agreed to buy what so ever is left. You selected 8 titles out the list , I confirmed all of them but unfortunately I found one CD is missing , I had only the cover. I informed that to you and requested you to confirm for balance 7 Cds. And you did confirm those CDs and agreed to pay including shipping charges (which were pretty reasonable for 7 CDs to ship to Mumbai or to be delivered to a place 15 KM my place)

And then all of a sudden you changes your mind for some phoney reason and called off the deal.

So people here on thsi forum, my sincere appleal is to go through the entire transaction and decide who is at fault.

so what is wrong if I ask for petrol expenses for 20/30 KM of travel ?


Geez ! I thought these were courier charges, not your personal petrol re-imbursement...


TO SUMMARISE MY PERSPECTIVE :


1. You put up 12 CDs for sale, in yr 1st List. I confirmed all 12.

2. You did not reply to my Forum posting and PM, but sold off the cream, locally, on Cash & Carry.

3. I agreed to take the remaining 8.

4. You knocked off 1 more CD from the list... reducing it to 7.

3. I STILL said I would take the lot, and you agreed to deliver it to a local address in Pune.

4. You the ask for Rs 125 delivery charges.

I just found the entire transaction disgusting and a waste of time to continue the correspondence..

Did you tell anybody on this forum without asking about how much you paid for that power amp , pre amp and speakers you recently bought? It could be confidential and you thought it is unnecessary to disclose , isn't it ? Then how you expect me to tell all my transaction details to you like a running commentary?




To summarise again:

1> I never confirmed the original list from Amp_Nut
2> I confirmed only 8 CDs
3> Out of those 8 CDs confirmed I withdrew only 1 CD for a valid reason and that was communicated to AMp_Nut and his confirmation was saught.
4> Amp_NUt , misunderstood, Alnakar Cinema and Alanakar police chowky. Hearing or understanding problem.

5>My charges of Rs 125 for a 30 KM travel and 2 hous' of time. That was reasonable by all means.



Amp-Nut called off the deal just because of that Rs 125, I believe, he wanted a free delivery which was not possible given the throw away price sale. Period.




I believe the truth is in front of all.



Now for me the topic is closed.

Bhagwan, you are coreect on both these. I own an Apple iBook that came with all licenced software (2 DVD ROMs) that came with iBook. I have a payement reciept for the same.

My other machine is a DELL PC (with Bill and warranty) and that too came with official Win XP home edition preloaded and I have a official DELL System disc to restore my PC .

I don't use MS office, Photoshop or Coreldraw. I have a licencd copy of TurboCAD and Paint Shop Pro Anniversary edition. Instead of MS Office I use Openoffice on Winodws and Neo office on MAC both these software suites fall under under 'Open Software platform' where no licence is required.

Anyway, Bhagwan, thanks for the trust and confidence shown in me!!!!

After I read what you had to write on another thread - I had to believe in you;
Very few persons I know that would not 'buy' a CD & spend that money on a 'child's eductation' & I have aplauded you for that 'noble gesture' !! Keep up the good work !!

p.s. I am not into music downloads & have no idea of how it works.
I do have a 'few' XRCD's myself - however I am not a 'fan' of the 'recording' !!!
Maybe I need buy some more 'FIM & LIM' to understand what is going on.....

And money to make this kind of investment in music!

My entire collection accumulated over past 4-5 years is less than 400 CDs but I believe there are many other important priorities in my life than music!

I feel myself fortunate to have resources to build a music system costing 150 K+ and accumulating music worth 100 K+ but not everybody is.

I am helping an orphan kid (through a NGO) for last two years. I take care of his school fees , books and clothing and also contribute for expenditure towards food and shelter.

Yes, I am buying a CD or two less per month (Rs 600~1000) but that helps an orphan kid to go to school. Smile on that kid's face and his soft 'Thank you' is the best ever DVD / CD I ever bought!

For me this kind of satisfaction is far more important than having couple of more (dust gathering) CDs in my rack.

Just my thoughts.

But your sanctimonious attitude in this and another thread (quoted above), and holier than thou posts, made me post my experience when dealing with you.

Blowing your own trumpet about your "good" deeds is in bad taste.The Good Book says "When you give to the poor, don't let your left hand know what your right hand is doing."

Several of our forum members will be doing their bit for good causes in whatever way they can.It is not for us to judge if what they are doing is enough,nor is it our concern on how they choose to spend their money.

Regarding the XRCD transaction,you did not tell me that you had another offer when you asked me to send you the money.You,in fact led me to belive that the XRCD was mine by mentioning in your email, that I had made a good choice and that you have another personal copy of the same XRCD, and it was one of your favourites. Is it any wonder that I was annoyed when you said that you "cannot fill my order"?

By asking me to send you money for the XRCD even while you had confirmed the sale to another person is itself unethical in my book.

I think with Rajiv and Amp_Nut, I am dead sure that I haven’t cheated them or did anything unethical. I wrote lengthy messages with complete facts and figures clear enough to remove any doubts or misunderstanding. Readers are free to make any judgment of their own.

Now that I have made my point very clear .I stop here as I have no time and inclination to drag this into an unending argument.

I can't access this forum from office but that doesn't mean I can't access it from else where.

Amp_Nutji, I can be at home even on a working day.. people call it as a Casual Leave. And at home I have a PC and internet connection too.

Hi All,

Just wanted to add my comments here -

I feel Suhas is taking unncessary flak and issues are being mixed up.

I have also bought about 25-30 CDs from Suhas and he came across an absolutely A++ seller. Everything was completely clean and above board and whatever promises he made, he scrupulousy stuck to. All the CDs were in the condition he mentioned and the packaging was bullet proof !!

We need more such sellers ... I would not hestitate to pick up anything he has to offer and which also interests me ..
