Greetings German friends, I need help.

I hope this isnt't disrupting anyone and I'm sorry if this is wrong forum to post, but I'm really desperate at the moment.

(Sorry for the english not being really good, but I hope it is understandable)


The "story"

I ordered beamer from screenmaxx.com 23 November, 2006 and it have never arrived to me. After allmost 2 months from the order day someone there bothered to answer my in enquiry and told shipping company have lost my beamer and they're taking legal actions againts the shipping company, then they told me I had to send them statement under oath that I never got beamer I ordered. After sending the statement, I was told everything is okey with it. (time was 05-Feb-2007)

Then came long silent time when noone again answered my emails, I got really bored to this and sended (11-Apr-2007) enquire with nothing else in it then something like "Hohoo! anybody there?" and I got answer in couple hour from the very same person who I had sended my statement that I never got the beamer. He told he is really new to my affair and how could he help me, I reminded him that he had been dealing with me earlyer and asked about my order, but didn't get answer and havent got any emails after this.

Late last month I phone called them first time and was promised to get email from them, and new offer for the beamer with discount withing couple hours. (I was told someone in charge was in meeting or something, and after he comes back he emails or calls me.) Well never got email or phone call and called them again in 2-3 weeks after the first call. This time I was told they need to check booking that they havent payd me back allready and after they have checked it they email or call me. Well havent got any calls or emails to this day and probably will never get.


Now to the question.

I'm just being really unlucky or is screenmaxx just on hoax company?

Is there any place in German that I could contact which wouldn't cost like hell to get help, or do I need to hire lawyer to get help? Here in Finland we have free goverment organisation for customers to get help if shops/companies/corporation things cheat them, try to avoid warranty things and in general all arguments between customers and shops, well is there samekind of organisation in German? I have found this The European Consumer Centre but havent contacted yet because complaint form isn't online.

Welcome to the Hifi Forum Ville.

I did a quick research on the shop on our german price comparision websites. Some negative Reviews, some positive.
It does not make the impression that they generelly defraud people, they just seem to be one of the many, "less-well" organised online stores out there where things go bad as soon as anything out of the ordinary occures.

I cannot give you much help on the legal side of things since I am no lawyer.

First check if you have any options to forcibly withdraw your payment. (You should have done so back in December!)
If you paid by Creditcard or Paypal you have/have had, options to do so.

If you paid with a money order, bank transfer or similiar that is not an option then.

I am not aware of a german institution that pursues the consuments interests in the way you described. Especially not for free and most likely not internationally either.
Other than the police of course. Which you should try contacting. (You will have to check if you can contact german police directly, or if it has to be done via your local police in Finland)

If you have some kind of law-insurance you should try to get in touch with a professional. (Lawyer)

Other than that your best bet is probably a more demanding communication with the seller.

Make clear that your patience is used up, that you intend to purse legal actions. Appoint a deadline for when you expect to have gotten your refund or replacement. If the refund/replacement has not arrived you will see a lawyer and see to your interests being professionaly taken care of.


Other than that I don't see all that many options for you right now.

mh, don't write emails thats not impressive enough.
With a serious letter you'll get more Attention

Like my previous speaker said, its not an hoaxcompany - they are just overtaxed, so make as much negative advertisement as you can
If its realy a Hoaxcompany you can call the Staatsanwaltschaft (STA), the german government agency for crimes.

of corse there is an german consumer centre, but i think they aren't intressted in such a little case

Yes that is a good idea. Make sure the letter has to be 'signed for' to ensure somebody has to give signature upon reception.

Be very clear in your demands. Appoint deadlines. Make sure you include information where and how they can refund the money. (So they cant give that as an excuse).

Make sure to include the original bill, refernce number, and all that to leave them NO ROOM for cheap excuses.
